Assessee engaged in a business, he introduce customers to different banks and financial institutions, for loan. Once loan is disbursed banks used to pay him certain fix rate of commission, Assessee appealed in CESTAT contending he is acting as a marketing agent for banks and such activity would not attract services tax.
Tribunal held that since assessee sourcing customer for banks and engaged in promotion & marketing of loan services provided by the banks, in other words banks are client of assessee.
Such activity falls under the business auxiliary services, hence Assessee has to pay service tax.
